1. About the Bitworks SMS Program

These SMS Terms and Conditions govern transactional text messages sent to and received from 651-465-3225 by The Bitworks, Inc., a Minnesota corporation currently doing business as Bitworks IT.

In these SMS Terms and Conditions, “Bitworks,” “Bitworks IT,” “we,” “us,” and “our” refer to The Bitworks, Inc.

The public-facing name of this messaging program is the:

Bitworks IT Support and Verification SMS Program

The SMS program is operated under the Bitworks IT brand. If our assumed business name or public-facing brand changes, we will update these SMS Terms, our sender identification, and any required messaging registration before using a different brand for this program.

651-465-3225 is the only telephone number Bitworks uses to send and receive messages through this SMS program.

These SMS Terms supplement our Privacy Policy and any applicable agreement between Bitworks and a client.


2. Program Description

The Bitworks IT Support and Verification SMS Program is a transactional messaging program used to communicate with existing clients and their authorized contacts.

Bitworks may use SMS to:

  • Send a one-time identity-verification or multifactor-authentication code requested during a support interaction;
  • Verify that a person contacting Bitworks is authorized to request support, account access, an administrative change, or another sensitive action;
  • Acknowledge an open support ticket;
  • Provide status updates concerning an open support ticket;
  • Request information needed to investigate or resolve an open support ticket;
  • Coordinate scheduling or availability related to requested support;
  • Notify an authorized client contact that a support matter has been resolved or requires additional action;
  • Receive replies concerning an existing support ticket; and
  • Respond to a text message initiated by a client or authorized client contact.

This program is limited to authentication, security, client support, and service-related communications.

Bitworks does not use this SMS program for advertising, promotional campaigns, lead generation, sales solicitations, or unrelated marketing messages.


3. Eligibility

The SMS program is intended for:

  • Current Bitworks clients;
  • Owners, employees, contractors, or representatives designated as authorized contacts by a Bitworks client;
  • Individuals contacting Bitworks on behalf of an existing client; and
  • Other individuals who specifically request a transactional verification or support-related SMS message.

Receiving a text message from Bitworks does not establish a client relationship. The applicable service agreement or other written agreement determines whether Bitworks has agreed to provide support or other services.


4. How You Consent to Receive Messages

Bitworks may send a transactional SMS message when you:

  • Ask Bitworks to send a verification code to your mobile telephone number;
  • Ask to receive SMS updates concerning an open support ticket;
  • Verbally agree during a support call or other interaction to receive support or verification messages;
  • Provide written or electronic consent through an approved Bitworks form, portal, or communication;
  • Initiate an SMS conversation with Bitworks at 651-465-3225; or
  • Otherwise expressly request or agree to receive a specific transactional message.

When consent is obtained verbally, Bitworks may document the consent in the applicable support ticket, client record, or communication record.

By providing a telephone number and requesting or agreeing to SMS communications, you represent that:

  • You are the subscriber or customary user of that telephone number;
  • You are authorized to consent to messages sent to that telephone number;
  • The telephone number you provided is accurate;
  • You agree to receive the transactional messages described in these SMS Terms; and
  • You understand that some messages may be generated or delivered through an automated or application-based messaging system.

Consent is voluntary and is not a condition of purchasing Bitworks services.

A publicly available telephone number, inclusion in a client contact record, or an established business relationship does not, by itself, enroll a person in recurring SMS communications.


5. Scope of Your Consent

Consent is limited to the Bitworks IT Support and Verification SMS Program.

One-Time Verification Codes

When you request a one-time identity-verification code, your request authorizes Bitworks to send the requested code and any message reasonably necessary to complete or document that verification attempt.

Requesting a verification code does not enroll you in marketing messages or unrelated recurring SMS communications.

Support-Ticket Messages

When you request or agree to SMS updates concerning a support ticket, your consent authorizes Bitworks to send transactional messages reasonably related to that support matter.

These messages may continue until:

  • The support matter is resolved or closed;
  • SMS is no longer reasonably necessary for the support matter;
  • You ask Bitworks to use another communication method; or
  • You opt out of SMS communications.

A new support matter may require a new request or new consent unless you have separately agreed to receive ongoing transactional support communications from Bitworks.

Messages You Initiate

When you initiate a text conversation with Bitworks, you consent to receive replies reasonably related to your message and the applicable support matter.

SMS consent is specific to Bitworks and this messaging program. It is not sold, transferred, or assigned to another business, affiliate, messaging campaign, or unrelated purpose.


6. Message Frequency

Message frequency varies.

For one-time identity verification, you will ordinarily receive one message per verification request, although an additional message may be sent if a code must be reissued or the verification process requires clarification.

For support-ticket communications, message frequency depends on:

  • The nature of the support request;
  • The number of updates or questions associated with the ticket;
  • Your responses;
  • Scheduling requirements; and
  • The amount of communication reasonably necessary to resolve or document the support matter.

Messages concerning a support ticket may continue while the ticket remains open.

Bitworks does not maintain a fixed or scheduled SMS marketing list through this program.


7. Message and Data Charges

Message and data rates may apply to messages sent to Bitworks and messages received from Bitworks.

Charges depend on your mobile carrier, telephone plan, and other arrangements with your telecommunications provider.

Bitworks does not charge a separate fee to enroll in the SMS program, but ordinary support charges may apply to the underlying support work in accordance with the applicable client agreement or service plan.

Contact your wireless carrier if you have questions regarding your text-messaging or data plan.


8. How to Opt Out

You may cancel SMS communications from Bitworks at any time by replying:

STOP

After you send STOP, you may receive one final message confirming that you have been unsubscribed. After that confirmation, Bitworks will not send additional SMS messages to that number through the applicable program unless you later initiate a new SMS conversation or provide new consent.

You may also revoke consent by:

  • Calling Bitworks at 651-465-3225;
  • Telling a Bitworks representative that you no longer wish to receive SMS messages; or
  • Using another reasonable method that clearly communicates your request to stop SMS communications.

Opting out of SMS does not:

  • Cancel an open support ticket;
  • End a client’s service agreement;
  • Prevent Bitworks from communicating through telephone, email, a support portal, or another available method;
  • Prevent Bitworks from maintaining a record of the opt-out request; or
  • Prevent communications that are otherwise permitted or required by law.

Opting out may require Bitworks to use another method to verify your identity or communicate about a support request.

To receive SMS messages again after opting out, you must initiate a new request or otherwise provide new consent.


9. Obtaining Help

A HELP response may include:

  • The Bitworks IT program name;
  • Customer-support contact information;
  • A reminder that message and data rates may apply; and
  • Instructions for replying STOP to opt out.

Do not use SMS for emergencies, urgent threats to health or safety, or matters requiring immediate response.

SMS is not guaranteed to be monitored continuously or outside Bitworks’ normal support operations.


10. Support Requests Sent by SMS

SMS is primarily used for verification and communication concerning existing support matters.

Sending a text message to 651-465-3225 does not, by itself, guarantee that:

  • A new support ticket has been opened;
  • The message has been immediately reviewed;
  • A technician has been assigned;
  • The matter will receive emergency or after-hours response; or
  • Bitworks has accepted responsibility for the requested work.

A support request should not be considered accepted until Bitworks acknowledges the request or confirms that a ticket has been created.

Replies to support-related SMS messages may be added to the applicable support ticket, client record, security record, or service history.


11. Message Delivery and Carrier Availability

SMS delivery depends on services provided by mobile carriers, telecommunications providers, messaging platforms, networks, devices, and other systems outside Bitworks’ direct control.

Messages may be:

  • Delayed;
  • Filtered;
  • Blocked;
  • Duplicated;
  • Misrouted; or
  • Undelivered.

Mobile carriers are not liable for delayed or undelivered messages.

Bitworks does not guarantee that SMS will be available through every carrier, device, telephone plan, or geographic location.

When an SMS message cannot be delivered or is not appropriate for the communication, Bitworks may attempt to contact you through another available method.


12. Privacy and Use of Mobile Information

Information collected through the SMS program is governed by the Bitworks Privacy Policy.

Information collected through SMS may include:

  • Your name;
  • Your company or organization;
  • Your mobile telephone number;
  • Message content;
  • Support-ticket numbers;
  • Dates and timestamps;
  • Message delivery and response information;
  • Identity-verification results;
  • Consent records;
  • Opt-in method;
  • Help requests;
  • Opt-out requests; and
  • Other information reasonably necessary to document or respond to the interaction.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

Bitworks does not sell, rent, transfer, or disclose mobile telephone numbers, SMS message content, SMS opt-in information, or SMS consent records to third parties, affiliates, lead generators, or other organizations for their own marketing or promotional purposes.

Bitworks may disclose mobile information to telecommunications carriers, messaging-platform providers, support-platform providers, and other service providers only as reasonably necessary to:

  • Transmit or deliver messages;
  • Operate the SMS program;
  • Provide requested client support;
  • Maintain consent and opt-out records;
  • Prevent fraud, abuse, or unauthorized access;
  • Protect Bitworks and client systems;
  • Troubleshoot delivery problems; or
  • Comply with applicable law.

These service providers are not authorized by Bitworks to use mobile information or SMS consent records for their own marketing or promotional purposes.


13. SMS Security

SMS is not an encrypted or inherently secure communication channel.

Do not send the following information to Bitworks by SMS:

  • Passwords;
  • Password-reset links;
  • Authentication secrets;
  • Recovery codes;
  • Authentication codes issued by another company or service;
  • Social Security numbers;
  • Full payment-card information;
  • Complete banking credentials;
  • Protected health information;
  • Government identification documents; or
  • Other highly sensitive personal or confidential information.

A verification code issued by Bitworks should be used only for the specific Bitworks support interaction for which it was generated.

Bitworks will not ask you to send a password or a third-party authentication code through SMS.

When sensitive information must be exchanged, Bitworks may direct you to an approved secure communication or verification method.


14. Telephone-Number Changes and Reassignment

You are responsible for notifying Bitworks if:

  • Your mobile telephone number changes;
  • You are no longer the subscriber or customary user of the number;
  • The number is transferred to another person;
  • Your authority to act for the applicable client ends; or
  • You no longer wish to receive SMS communications.

You should opt out or notify Bitworks before relinquishing a telephone number.

Bitworks may suspend SMS communications when it receives information indicating that:

  • A number has been reassigned;
  • The intended recipient is no longer associated with the client;
  • The recipient is no longer authorized to receive client information;
  • Continued messaging may create a security or privacy risk; or
  • Consent can no longer be reasonably established.

15. Misuse of the SMS Program

You may not use the Bitworks SMS program to:

  • Transmit unlawful, threatening, abusive, deceptive, or malicious content;
  • Impersonate another person;
  • Attempt to gain unauthorized access to a client or Bitworks account;
  • Submit passwords, stolen authentication codes, or other unauthorized credentials;
  • Interfere with the operation or security of the messaging service;
  • Send malware, malicious links, or harmful files;
  • Harass Bitworks personnel or another person; or
  • Use the program for a purpose unrelated to legitimate client support or communication.

Bitworks may block, restrict, or discontinue SMS communications when reasonably necessary to prevent misuse, fraud, abuse, unauthorized access, or a security incident.


16. Suspension or Termination of the Program

Bitworks may modify, suspend, or discontinue the SMS program, in whole or in part, when reasonably necessary because of:

  • Changes in our services;
  • Changes in technology or messaging providers;
  • Carrier requirements;
  • Security concerns;
  • Legal or regulatory requirements;
  • Misuse of the program;
  • Termination of a client relationship; or
  • Other legitimate business or operational reasons.

Discontinuing the SMS program does not affect rights, responsibilities, payment obligations, or service terms arising under an applicable client agreement.


17. Changes to These SMS Terms

Bitworks may update these SMS Terms to reflect changes in:

  • Program features;
  • Message purposes;
  • Consent procedures;
  • Technology providers;
  • Carrier requirements;
  • Applicable law;
  • Privacy practices;
  • Contact information;
  • Public-facing brand names; or
  • Business operations.

The revised SMS Terms will be posted with a new “Last Updated” date.

When a change materially affects an existing SMS enrollment, Bitworks will provide additional notice when reasonably appropriate or required by law.
